Terms of Service
Last Updated: November 2025
These Terms of Service govern your use of Legacy Trust's website and legal services. By accessing our website or engaging our services, you agree to be bound by these terms.
1. Definitions
"Services" refers to legal services provided by Legacy Trust, including will drafting, estate planning, probate administration, and trust formation.
"Client" or "You" means any person or entity that engages our legal services or uses our website.
"Website" refers to all pages and content hosted under our domain.
"We," "Us," or "Our" refers to Legacy Trust and its lawyers and staff.
2. Use of Services
Eligibility
Our services are available to individuals and entities with legal capacity to enter into binding contracts. You must be at least 18 years old to engage our services independently. Services for minors require parent or guardian involvement.
Professional Relationship
A lawyer-client relationship is established only when we provide you with a formal engagement letter confirming our representation. Initial consultations and general information provided on our website do not create a lawyer-client relationship.
Accurate Information
You agree to provide accurate, complete, and current information when engaging our services. Inaccurate information may affect the quality and effectiveness of legal advice and documents we prepare.
3. Prohibited Uses
You may not use our services or website to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful or malicious code
- Attempt unauthorized access to our systems
- Engage in fraudulent activities
- Harass or harm other users or our staff
- Collect information about other users
- Use our services for illegal purposes
4. Intellectual Property Rights
All content on our website, including text, graphics, logos, and software, is owned by Legacy Trust or licensed to us. This content is protected by copyright and other intellectual property laws.
You are granted a limited license to access and use our website for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from our content without written permission.
Legal documents we prepare for you remain your property. However, the underlying templates, forms, and methodologies are our intellectual property and may not be reproduced or used for commercial purposes.
5. Service Terms and Fees
Engagement Terms
Each legal engagement is governed by a written engagement letter specifying the scope of services, fees, and other relevant terms. You should read and understand the engagement letter before signing.
Fee Structure
Fees for our services are outlined in the engagement letter. Standard services have published starting prices, while complex matters require individualized quotes. All fees exclude applicable taxes unless stated otherwise.
Payment Terms
Payment is typically required upon completion of services. For probate administration and trust matters involving ongoing work, we may invoice at regular intervals. Outstanding invoices are due within 30 days of the invoice date.
Disbursements
You are responsible for disbursements incurred in providing services, including court filing fees, valuation costs, and expenses for coordinating with foreign lawyers. These are billed at actual cost plus reasonable administrative charges.
6. Disclaimers and Limitations of Liability
No Warranties
Our services are provided on an "as is" basis. While we strive for excellence, we make no warranties about specific outcomes. Estate planning effectiveness depends on numerous factors including future legal changes and family circumstances.
Limitation of Liability
To the extent permitted by law, our liability for any claim arising from our services is limited to the fees paid for those services. We are not liable for indirect, consequential, or punitive damages.
Third-Party Content
Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites. Links do not constitute endorsement.
Professional Indemnity
We maintain professional indemnity insurance as required by law. Claims against our services should be reported promptly to allow proper investigation and resolution.
7. Confidentiality
We are bound by legal professional privilege and strict confidentiality obligations. Information you provide is protected and will not be disclosed without your authorization, except where required by law.
Confidentiality continues after services are completed. File records are maintained according to professional requirements even after the lawyer-client relationship ends.
In limited circumstances, we may need to disclose information to comply with legal obligations such as anti-money laundering reporting, court orders, or regulatory investigations.
8. Termination
Either party may terminate the lawyer-client relationship with reasonable notice, subject to our professional obligations. If you terminate services, you remain responsible for fees incurred up to termination.
We may terminate representation if there is a conflict of interest, non-payment of fees, loss of communication, or if continuing would violate professional rules. We will provide appropriate notice and return documents as required.
Upon termination, certain provisions of the engagement letter survive, including confidentiality obligations and fee payment requirements.
9. Dispute Resolution
Informal Resolution
If you have concerns about our services, please contact us first to discuss them. Many issues can be resolved through direct communication.
Mediation
If informal resolution is unsuccessful, we agree to attempt mediation before pursuing formal proceedings. Mediation costs are shared equally unless otherwise agreed.
Governing Law and Jurisdiction
These terms are governed by Singapore law. Any disputes that cannot be resolved through mediation will be subject to the exclusive jurisdiction of Singapore courts.
Professional Complaints
You may file complaints about our conduct with the Law Society of Singapore in accordance with their complaints procedures.
10. Changes to Terms
We may modify these terms periodically to reflect changes in our practice or legal requirements. Material changes will be posted on our website with an updated "Last Updated" date.
For active clients, we will notify you of material changes to terms that affect your engagement. Continued use of our services after changes constitute acceptance of modified terms.
Terms in individual engagement letters supersede these general terms of service where there is conflict.
11. General Provisions
Entire Agreement: These terms, together with the engagement letter, constitute the entire agreement between you and Legacy Trust regarding use of our services.
Severability: If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full force.
No Waiver: Our failure to enforce any provision does not constitute waiver of that provision or any other provision.
Assignment: You may not assign your rights or obligations under these terms without our written consent. We may assign our obligations with appropriate notice.
Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
